NATURE OF THE CASE: This was an appeal from a summary judgment against P.
FACTS: Ramsey (P) owned real property in Maricopa County. P listed the property for sale with Zee Realty. The property was described in the listing (see page 887 Rabin 4th). A sale was negotiated and an escrow was opened with Arizona Title (D). The escrow instructions contained a description of the property and a deed was drafted containing its description. This suit ensued to determine the exact nature of what was conveyed. The trial court ruled in summary judgment in favor of D and P appealed.
