NATURE OF THE CASE: This was a criminal prosecution for murder.
FACTS: Holland (D) attacked Garland and cut him on the finger. Garland refused to have
the finger amputated to prevent lockjaw. Garland contracted lockjaw and then had the finger
cut off but died anyway. D was charged with murder. At trial, the surgeon testified that if
the finger had been cut off promptly death would not have resulted.
