NATURE OF THE CASE: This was an appeal from a conviction for larceny.
FACTS: Turvey (D) arranged a conspiracy to steal and sell table knives, spoons, etc.,
from the government. D recruited one employee to take the property and give it to him. D
then contacted Ward about the scheme and Ward went to the authorities. They told Ward to
give D the goods. Ward did so and D took away the utensils. D was arrested for stealing and
was convicted. D appealed.
