NATURE OF THE CASE: This was an appeal over the issue of void for vagueness on a sodomy statute.
FACTS: Locke (P) was convicted of crimes against nature in statute court. P filed for habeas corrupt and the 6th Circuit eventually held the statute void for vagueness. Rose (D), the warden appealed and the Supreme Court granted certiorari.
