NATURE OF THE CASE: This was an appeal from a kidnapping conviction.
FACTS: Rupert (D) was charged with kidnapping. He entered a plea of not guilty by reason of insanity. The jury determined that D was sane at the time and then he changed his plea to not guilty. D was convicted and appealed.
