SCHMIDT V. SCHMIDT, 444 N.W.2d 367 (1989) CASE BRIEF

SCHMIDT V. SCHMIDT
444 N.W.2d 367 (1989)
NATURE OF THE CASE: This was an appeal of custody and child support.
FACTS: H and W were divorced in 1984. They had three children during their marriage. By stipulation, W got custody of all three. H was ordered to pay $375 per month in child support. In 1988, H made a motion to modify the custody by requesting custody of the eldest son (14) and that all three boys be allowed to reside with him during the summer months. The trial court amended the decree and gave custody of the eldest to H and reduced child support to $250 per month and $125 per month during the summer months when all three boys stayed with the H. Both H and W appealed.
