NATURE OF THE CASE: This was an appeal from a trial court order to foster affection for a noncustodial father. W appealed an order which required W to create in the children's minds a loving, caring feeling toward H.
FACTS: H and W were divorced after six years. Custody of the children was initially given to H but that was modified and W got sole custody. W did not exercise her duties as a custodial parent and moved away without notification, made visitation impossible and fostered hatred towards H from the children. The trial court found in 1985, that W had totally failed in her custodial duties of fostering a loving relationship between the children and H. The trial court ordered W to do everything in her power to create in the minds of the children that they should love their father and that a breach of that duty would result in the severest of penalties including contempt, prison, loss of residential custody of any combination thereof. W appealed.
