NATURE OF THE CASE: Smith (P) appealed an order, which directed a verdict for Rapid (D) in P's action to recover for injuries sustained after being involved in an automobile accident allegedly caused by D's bus.
FACTS: P was driving an auto down Main Street when a 'great big, wide affair' bus forced her to turn right and her auto collided with a parked car. P could not identify the bus that forced her off the street. Evidence showed that D's bus line drove down that street near the same time. The trial court directed the verdict against P and P appealed.
