NATURE OF THE CASE: Holloman (D) appealed from a judgment of the Johnston County Superior Court, which granted Snead's (P) motion for a directed verdict on the issue of contributory negligence and failed to instruct the jury on P's duty to mitigate damages.
FACTS: There apparently was some kind of accident and P sued D and D plead contributory negligence. P moved for a directed verdict on that affirmative defense and it was granted. D appealed.
