NATURE OF THE CASE: This is yet another dispute over crimes against nature.
FACTS: D was charged with numerous counts of abominable and detestable crimes against nature pursuant to a statute. The alleged acts took place with the victim was over the age of sixteen. While the indictment was pending the legislature repealed certain provisions of the statute; they basically deleted mankind from the equation. As such, the court dismissed the counts related to that statute based on the legislative repeal. This appeal resulted.
