NATURE OF THE CASE: This was an appeal from a dismissal of charges based on an insufficient probable cause affidavit.
FACTS: Thompson (D) was the principal and the boys basketball coach at Hobson High School. D was accused of two counts of sexual intercourse without consent and one count of sexual assault. The information indicated that D committed the crime of sexual intercourse without consent with Jane Doe, by threatening Jane Doe that she would not graduate from high school. They alleged that the threats caused Jane Doe great psychological pain and fear.
