NATURE OF THE CASE: This was a dispute over an engagement ring.
FACTS: Haber (H) and Vigil (W) exchanged engagement rings. Their relationship quickly deteriorated and got very physical. The couple separated and W filed for a protective order. The protective order was issued and the parties were ordered to return the engagement rings they had given to each other. W objected to returning her ring. The police were instructed to hold the ring until the matter was settled. H filed a motion in district court to have the ring given to him. The court found that W had cancelled the wedding but that was based on H's misconduct and then ordered that W could keep the ring. H appealed.
