NATURE OF THE CASE: This was an action in fraud.
FACTS: D sought to purchase land from P. D told P that he was going to build dwellings on
the lot. In fact, D was going to build an automobile garage. P sold to D and then D began to
build the garage. P tried to recover the lot out of court and D refused. P sued D for fraud.
A referee found in favor of P and D appealed.
