NATURE OF THE CASE: This was an admiralty action in negligence.
FACTS: Donau Maru (D) spilled fuel oil in Boston Harbor. This prevented the Tamara from docking at a nearby birth. Tamara discharged her cargo at another pier and P sued D for the extra costs incurred. The court denied recovery on the basis of the pleadings. P appealed.
