NATURE OF THE CASE: This was a will contest. Clark (P) sued the state and sought to
recover under the terms of decedent's will. The state claimed that the bequest was invalid
for want of certainty.
FACTS: A clause in Testator's will devised personal property to Testator's trustees, to
be distributed to Testator's friends. The beneficiaries were not named.
