NATURE OF THE CASE: Crumpton (Ps), the injured party and her husband, challenged a judgment which granted summary judgment in favor of Humana (D), a hospital and a nurse.
FACTS: Crumpton (P) underwent surgery at Humana (D). P alleges that she sustained head and neck injuries when an attending nurse attempted to lower her bed. Suit was file more than three years later. A motion was granted for summary judgment as it was barred by the statute of limitations. P appealed.
