NATURE OF THE CASE: This was a loss of consortium and personal injury action.
FACTS: Marcial and Dolores (P) sued Costa and Rosemar (D) claiming Marcial sustained personal injuries and P sustained a loss of consortium due to D's wrongful conduct. Marcial and P lived together as a defacto married couple but were not in fact married. D moved for summary judgment on the loss of consortium claim. P appealed.
