FACTS: P, husband and wife, sued D for invasion of privacy. P rented a dwelling house from D and D lived in the home next to P. P alleged that D installed a concealed listening and recording device in his bedroom and that it was discovered and it caused distress, humiliation, and embarrassment. D moved to dismiss.
