NATURE OF THE CASE: This was an appeal of a reversal of a summary judgment by the trial court in a dispute over the causation element in tort action against contractors for school maintenance employee's fall from a ladder.
FACTS: Ron Virden (P), worked in the maintenance at a High School. P's supervisor asked him to reinstall an angle iron that had fallen from the ceiling of the school's new wrestling room. P fell from the top of the ten-foot ladder and sustained severe injuries to his left leg, requiring several surgeries. P sued Betts & Beer (D) who had installed the wrestling room ceiling a few months before. The district court granted summary judgment to D. It held D's negligence was not the proximate cause of P's injuries. P appealed and the court of appeals reversed. The Supreme Court of Iowa granted review.
