NATURE OF THE CASE: This was a dispute over an award of the Employee's Compensation Commission.
FACTS: This suit was brought in the United States District Court to enjoin the enforcement of an award made by Crowell, (P) as deputy commissioner of the United States Employee's Compensation Commission in favor of Knudsen and against Benson (D). The award was made under the Longshoreman's and Harbor Workers' Compensation Act and rested on a finding by P that Knudsen was injured while in the employ of D and performing service on navigable waters of the United States. D alleged that the award was contrary to law because at the time of the injury Knudsen was not an employee of D and his claim was not within the jurisdiction of P and that the Act, which P acted under, was unconstitutional. The district court held a trial de novo.
