NATURE OF THE CASE: This was a dispute over the application of the Sunshine Act to agency budget deliberations.
FACTS: The NRC closed its budget proposal meetings to the public. Ps disputed that closure under the Sunshine Act. The District Court held that the agency acted unlawfully in closing a meeting on July 18, 1980 and ordered NRC to refrain from closing all such similar meetings in the future. The Court then adjudged the Commission in civil contempt for a closed meeting in July 25, 1981 and it could release that civil contempt by publishing a transcript of that meeting. A further such order was issued again for a meeting on October 15, 1981.
