NATURE OF THE CASE: This was a dispute over the issuance of an FCC license.
FACTS: Sanders (P) intervened in an FCC proceeding in opposition to Telegraph Herald's application for a license for a radio station that would compete with P's existing station. P complained that there was not enough advertising revenue in the area to support two stations. The license was issued and P sought judicial review under section 402(b) of the Federal Communications Act.
