NATURE OF THE CASE: This was a dispute over the scope of an arbitration agreement.

FACTS: Mitsubishi initiated arbitration in a dispute with Soler claiming that Soler had breached its dealership agreement by failing to take delivery of 996 vehicles. Soler claimed antitrust violations and Mitsubishi brought a proceeding in District Court to compel arbitration. The court ordered arbitration of the antitrust defense and counterclaims. Soler appealed.
