NATURE OF THE CASE: This was a dispute over a cold storage requirement.
FACTS: A Chicago ordinance prohibited cold storage houses from storing food unfit for human consumption and authorized summary seizure and destruction by city health officials of unfit food so stored. North American (P) was ordered to deliver up for destruction alleged putrid poultry. P refused to comply and the government threatened summary destruction of the goods and prohibited further deliveries to P's warehouse. P applied for an injunction to stop those actions. The lower court dismissed for want of jurisdiction.
