NATURE OF THE CASE: This was a dispute over the removal of a short order cook.
FACTS: Rachel Brawner was a short order cook in a cafeteria on the premises of the Naval Gun Factory in the city of Washington. Rachel had worked there for over six years and her record was entirely satisfactory with M&M Restaurants, Inc. The contract between Gun Factory and M&M required restaurant employees to meet naval security requirements. Rachel's security badge was withdrawn for the failure to meet security requirements. Rachel was not permitted to enter the Gun Factory. Rachel was offered employment at another M&M location but she refused in that the location was inconvenient.
