NATURE OF THE CASE: This was an action to recover for rent that was past due.

FACTS: Paradine (P) sued Jane (D) for a failure to pay rent for three years on leased lands. D's answer indicated that the lands had been occupied by Prince Rupert of Germany, and that D had been put out of possession. D argued that he was frustrated in the performance of his duties under the lease.
