NATURE OF THE CASE: This was an appeal from a conviction for involuntary manslaughter.

FACTS: Rodriguez (D) was the mother of four children (ages 2-6) and left them at home alone. Carlos, D's two-year-old, died in a fire at the home that night. Neighbors saved the other three children. D was convicted of criminal negligence and involuntary manslaughter. D appealed; her negligence was not criminal.
