168 Eng.Rep. 887 (1821).

NATURE OF THE CASE: This was a prosecution for larceny.

FACTS: Banks (D) borrowed a horse claiming that he needed it to take a sick child to the doctor. D took the child to the doctor but D sold the horse when a man offered to buy it. There was no evidence that D had intended to sell the horse when he originally borrowed it.
