NATURE OF THE CASE: This was an appeal of a larceny conviction.

FACTS: Sullens (D) was given a bank note by his employer and told to change it for silver. D took the change, converted it to his own use, and left town. D was indicted for the larceny of both the bank note and the change. D was acquitted on the charges for the bank note but was convicted for the larceny of the change. D appealed.
