NATURE OF THE CASE: This was an appeal from a murder conviction.

FACTS: Dumlao (D) was extremely suspicious and suffered from chronic paranoia and delusions. During an incident caused by his paranoia, he shot and killed his mother-in-law. The court refused instructions that the homicide could be manslaughter if it was done while under the influence of an extreme mental or emotional disturbance for which there is a reasonable explanation. The reasonableness of the situation was to be determined from a person in the shoes of D. D was convicted of murder. D appealed.
