NATURE OF THE CASE: This was an appeal from a conviction for theft.

FACTS: Kaufman (D) sold copper wire that was abandoned by the thief who stole it from a junk dealership. D was convicted of the theft of the wire. D appealed; the wire was not lost within the meaning of the criminal statute because it had been stolen and then abandoned.
