NATURE OF THE CASE: This was an appeal from the conviction of an assault with intent to commit rape.

FACTS: Bell (D) attempted to rape a female. The victim had a mental disease which made her unable to comprehend what was going on. D claimed that because the victim was incapable of forming a reasonable apprehension of bodily harm, no assault occurred.
