NATURE OF THE CASE: This was a dispute over bail pending appeal.

FACTS: Stanton and Robert Miller (D) were convicted and applied for bail pending appeal. The district court found that Ds were not likely to flee or pose a danger to anyone if released. The court also found that the appeal was not for simply delaying the finality of the sentence. The court denied bail pending appeal after concluding that in good faith it was not likely that the appeal would result in a reversal or an order for a new trial. Ds appealed.
