NATURE OF THE CASE: Whitlock (P) filed an action against Jackson (Ds) law enforcement officers after they arrested the decedent and inflicted serious injuries that caused his death. The jury returned a verdict awarding compensatory and punitive damages in favor of P and P then filed a motion for additur or for a new trial.

FACTS: Whitlock (P), as the administrator of the estate of her brother, Richard Gaisor, sued Jackson (Ds). P alleged that Ds arrested Gaisor and inflicted serious injuries upon him that caused his death. The jury found for P and awarded $29,700. P now argues that inconsistencies in the jury's answers to special interrogatories requires additur or in the alternative a new trial. D contends that P's failure to object to the inconsistencies constitutes waiver.
