NATURE OF THE CASE: This was an appeal of a conviction for grand larceny.

FACTS: Wilkinson (D) persuaded Whittington to claim three head of stray cattle that Ferguson found and was holding for their true owner. Whittington claimed the cattle, sold them, and gave part of the proceeds to D. D was indicted for grand larceny. D was convicted and appealed; he committed false pretenses and not larceny.
