NATURE OF THE CASE: This was a dispute over the sale of a condominium.
FACTS: Harrell (P) made a contract with Sea Colony (D) to purchase a condominium for about $75,000. The delivery date was to be January 1, 1974. The parties mutually agreed to extend that date until December 31, 1974. On November 12, 1974 P filed an action for damages under an alleged anticipatory repudiation. P claimed D sold his condo to another buyer. The trial court found for D. P appealed.
