NATURE OF THE CASE: This was a suit for damages under a 30-day provision in an employment contract. Inman (P) sought review of an order granting summary judgment in favor of Clyde (D), based upon a finding that P's action was barred due to his failure to comply with the notice provision in the contract upon which his suit was based.
FACTS: Inman (P) contracted to work for Clyde Hall Drilling Co. (D). The employment contract required P to give D 30 days notice for any claims arising from P's employment. D fired P on March 24. P filed suit against D on April 5 for breach of contract. D was served with P's complaint on April 14. D moved for a summary judgment; P failed to give written notice of his claim. D's motion was granted. P appealed.
