NATURE OF THE CASE: This was a dispute over a donation.
FACTS: Johnson (P) signed and delivered a pledge to Otterbein University (D) to pay off $100 of D's debt. P did not pay the note three years thence and D sued to collect upon it. The court of common pleas entered a judgment for D for the $100. P appealed.
