NATURE OF THE CASE: This was a contract dispute.
FACTS: Elmer (D) wrote a note that paid Moore (P) for her indebtedness on a mortgage note
to one Bogardus in repayment for past consideration. P in fact gave D sittings as a
clairvoyant and then D wrote the promise to pay off the Bogardus note.
