NATURE OF THE CASE: This was a dispute over a contract to delivery scrap steel.
FACTS: Luria (P) made a contract with Pielet (D) for D to delivery scrap steel. D did not
perform and during trial wanted to enter parol evidence regarding the fact that the written
contract was conditioned upon obtaining the scrap steel from a particular supplier. The
trial court refused to allow the testimony under parol evidence (UCC 2-202). D appealed.
