NATURE OF THE CASE: This was a dispute over the sale of seed.
FACTS: Nebraska Seed (P) claims that it has a contract to buy 1800 bu. of seed from Harsh (D). The transaction was started by D with a letter saying he had the seed and wanted $2.25 per bu. fob Lowell. P accepted the alleged offer to sell and D then refused to deliver. A jury trial resulted in a verdict for P. D appealed.
