378 U.S. 347 (1964).
NATURE OF THE CASE: This was an appeal from a conviction for criminal trespass.
FACTS: Bouie (D) went into a restaurant without notice that the owner could refuse entry. D refused to leave when asked to do so. D was indicted for criminal trespass. Before D's trial, a new law was passed that prohibited remaining on the premises when asked to leave. The prior law prohibited remaining on the premises when the accused had received notice before entry. D was convicted when the trial court interpreted the new law and the old law to mean the same thing.
