BROTHERHOOD OF RAILROAD TRAINMEN V. VIRGINIA EX REL. VA. STATE BAR
377 U.S. 1 (1964)
NATURE OF THE CASE: This was a dispute over the solicitation of legal business.
FACTS: The Union (D) was engaged in helping to assist its injured members and the families of members killed on the job by recommending them to lawyers whom it believes to be honest and competent. The Va. State bar challenged this plan and found that this channeled all the business to lawyers chosen by the Department of Legal Counsel for D. The court issued an injunction against D's carrying out its plan in Virginia. D claimed that this denied them their First and Fourteenth Amendment rights. This appeal resulted.
