NATURE OF THE CASE: This was a bill in equity to foreclose on a mortgage in real estate.
FACTS: An action was started to foreclose on a mortgage. D failed to appear and the bill was taken in pro confesso. On a motion for a decree, the justice began to worry about the jurisdiction and reported the case to a law court to determine if a decree should be made.
