NATURE OF THE CASE: Wife (W) sued Husband (H) for intentional infliction of emotional distress. H filed a motion to dismiss and the motion was denied. H then filed an amended motion to dismiss, which was denied. On appeal, the appellate court held that W could maintain an action at law. H's motion for leave to appeal was granted.
FACTS: Same facts as FELTMEIER V. FELTMEIER 777 N.E.2d 1032 (2002). H appealed the decision of the appeals court.
