NATURE OF THE CASE: Bagley (P) appealed a grant of summary judgment to Insight (D).
FACTS: P suffered severe brain and head injuries while working as an employee of Sam Friend, a subcontractor for Crawford, a television cable installer. Crawford, in turn, was functioning as a subcontractor for D, a central Indiana cable television company. P sued for damages based upon various theories of liability. The trial court entered summary judgment in favor of D and Crawford. The Court of Appeals affirmed in a divided opinion. P appealed.
