DANIELS V. EVANS
107 N.H. 407, 224 A.2d 63 (1966)
NATURE OF THE CASE: Evans (D) appealed from a decision after a jury verdict, which
entered judgment in favor of Daniels (P), estate administrator, in P's action to recover
damages for a decedent's death resulting from a motorcycle accident.
FACTS: Daniels' (P) son was killed when his motorcycle collided with Evans' (D) car. P's
son was nineteen years old. P sued to recover damages from the death of his son. The jury
ruled for P. D appealed, claiming that since the boy was participating in an adult activity
he should be held to the standard of care of an ordinary person.
