NATURE OF THE CASE: Floyd (P), a minor child, filed suit against Bic (D), manufacturer, for the negligent design and manufacture of a lighter. D filed a motion for partial summary judgment on the issue as whether D had a duty to manufacture a childproof lighter.
FACTS: P sued D in negligence for the failure to make a lighter that was not child proof. P alleged that she was injured when she was burned as a result of an allegedly defective or negligently designed adjustable butane lighter manufactured D. D moved for partial summary judgment.
