NATURE OF THE CASE: This was an action to recover damages for negligence.
FACTS: Goddard (P) was a passenger who had just arrived, and was about the length of a train car from leaving the train when he slipped on a banana peel lying on the platform, fell, and was injured. There was evidence of many people on the platform at the time of the accident. The verdict was directed for D and P excepted.
