NATURE OF THE CASE: Grotts (P), fianc, appealed a dismissal of her claim of bystander
emotional distress against Zahner (D).
FACTS: P and her fianc were involved in an accident with D. The fianc was killed. P
sued D seeking 'bystander' emotional distress damages in connection with fatal injuries
sustained by her fianc in the accident. The district court dismissed her claim of bystander
emotional distress on the ground that she was not, as a matter of law, 'closely related' to
her fianc for these purposes. P appealed.
